LITERAL RULE
Roll Numbers: 1-7
The Literal Rule is a primary rule of statutory interpretation where courts give words their plain, ordinary, and literal meaning. Under this rule, judges must apply the grammatical and natural meaning of words, even if the result appears to be unjust or contrary to the statute's intention.
GOLDEN RULE
Roll Numbers: 8-14
The Golden Rule is a modification of the Literal Rule. It provides that words should be given their ordinary meaning unless it would lead to absurdity, inconsistency, or repugnance. In such cases, the court may depart from the literal meaning to avoid unreasonable results.
MISCHIEF RULE
Roll Numbers: 15-21
The Mischief Rule, also known as Heydon's Rule, requires courts to consider what mischief or defect the statute was intended to remedy. The court examines the law before the statute, the problem it addressed, the remedy Parliament provided, and the reason for that remedy.
HARMONIOUS CONSTRUCTION
Roll Numbers: 22-28
The principle of Harmonious Construction requires that when two or more provisions of a statute or different statutes appear to be in conflict, they should be interpreted in such a way that gives effect to both provisions and maintains harmony between them.
GENERELIA SPECILIBUS NON DEROGANT
Roll Numbers: 29-35
This Latin maxim means "general things do not derogate from special things." When there is a conflict between a general provision and a specific provision in a statute, the specific provision prevails over the general provision.
NOSCITUR A SOCIIS
Roll Numbers: 36-42
The principle of Noscitur a Sociis means "a word is known by the company it keeps." Under this rule, the meaning of a doubtful or ambiguous word should be determined by reference to the words associated with it in the statute.
EJUSDEM GENERIS
Roll Numbers: 43-49
Ejusdem Generis means "of the same kind or nature." When general words follow specific words in a statute, the general words should be interpreted as being limited to things of the same kind as those specifically mentioned.
INTERPRETATION OF THE CONSTITUTION
Roll Numbers: 50-57
Constitutional interpretation involves understanding and applying the provisions of the Constitution. It requires special principles considering the Constitution's supremacy, its status as a living document, and the need to balance various rights and provisions.
INTERPRETATION OF TAXING STATUTES
Roll Numbers: 58-65
Taxing statutes are interpreted strictly. Any ambiguity or doubt should be resolved in favor of the taxpayer. The burden of taxation must be clearly imposed by the statute, and it cannot be presumed or implied.
INTERPRETATION OF PENAL STATUTES
Roll Numbers: 66-73
Penal statutes, which impose punishment or penalties, are strictly construed. Any ambiguity is resolved in favor of the accused. Clear and unambiguous language is required to create a criminal offense.
